الأصل، أنه إذا كان التحقيق الابتدائي الذي تجريه النيابة العامة مع المتهم سرّياً للعامّة، فإن التحقيق النهائي أمام المحاكم خلافاً لذلك؛ يكون علنياً، سواء أمام محاكم الصلح (المادة 307) من قانون الإجراءات الجزائية الفلسطيني رقم 3 لسنة 2001م، أو أمام محاكم البداية (الماد 237) من ذات القانون، أو أمام محاكم الاستئناف (المادة 333) واختياريا أمام محكمة النقض (المادة 366).
