النيابة في التعاقد
| یمكن تعریف النيابه بانها حلول ارادة شخص (وهو النائب) ، محل ارادة شخص آخر (وهو الاصيل) ،
في ابرام تصرف قانوني تنصرف آثاره الى ذمة الاصيل ، لا الى ذمه النائب .

| نجد في النيابة شخصا یعبر عن ارادته باسم غيره ولحساب هذا الغير
