مفاد المادة 40 من القانون المدنى أن الموطن هو المكان الذى يقيم فيه الشخص عادة بنية الاستقرار ولو تخللت الاقامة فترات غيبة متقاربة أو متباعدة ، وأنه يجوز أن يكون للشخص فى وقت واحد أكثر من موطن
